Terms and Conditions – BoilerSwaps Ltd

These terms and conditions apply to the supply and installation of boilers and related services by BoilerSwaps Ltd. By placing an order, you agree to these terms.

1. About Us

BoilerSwaps Ltd ("we", "us", "our") is a company registered in England and Wales.

We provide fixed-price boiler installation services for domestic properties.

2. Contract Formation

2.1. Your quotation is based entirely on the information you provide during the online quote process and any additional communication.

2.2. A contract is formed when we confirm your order by email.

2.3. The quoted price is based on the assumption that:

  • all information provided is accurate and complete;

  • site conditions match what has been described;

  • installation can be completed under standard conditions.

2.4. We reserve the right to refuse or cancel any order before completion where installation is not possible, safe, or reasonably achievable.

3. Accuracy of Information (VERY IMPORTANT)

3.1. You confirm that all information provided (including answers in the quote tool, photos and descriptions) is accurate and complete.

3.2. The fixed price is strictly based on this information.

3.3. If any information is:

  • incorrect

  • incomplete

  • misleading

  • or does not reflect actual site conditions

we reserve the right to:

  • revise the price;

  • delay the installation;

  • require additional works;

  • or cancel the order.

3.4. Where additional costs arise due to incorrect or missing information, these costs are the responsibility of the customer.

4. Photos and Pre-Installation Checks

4.1. We may request photos of your existing boiler, pipework, flue, surrounding area, loft, or external walls.

4.2. These must be accurate and representative of the actual installation environment.

4.3. Failure to provide requested information may delay or prevent installation.

4.4. Our engineer will verify site conditions on arrival.

5. Site Assessment and Changes on the Day

5.1. If, on arrival or during installation, we identify conditions that differ from what was described, we may revise the scope of work.

5.2. This includes (but is not limited to):

  • access issues

  • incorrect boiler location details

  • unexpected pipework layout

  • unsafe or non-compliant gas supply

  • electrical limitations

  • structural restrictions

  • presence of asbestos or hazardous materials

  • requirement for additional parts or labour

5.3. Where additional work is required, we will explain the situation and any additional costs before proceeding.

5.4. If you choose not to proceed, we may cancel the installation and refund amounts paid, minus reasonable costs already incurred.

6. What Is Included in the Fixed Price

6.1. The fixed price includes only the work and materials specified in your order confirmation.

6.2. The following are NOT included unless explicitly stated:

  • scaffolding or specialist access equipment

  • asbestos removal or specialist hazardous works

  • upgrades to gas, water or electrical systems

  • major system modifications

  • decorative works (plastering, painting, boxing-in)

  • flooring, tiling, cupboards or joinery work

  • bespoke aesthetic finishes

6.3. Pipework may be surface-mounted and visible.

6.4. Installation will be carried out based on practicality, safety and compliance rather than appearance.

7. Access, Parking and Permissions

7.1. You must provide safe and unobstructed access to the property.

7.2. You must ensure:

  • an adult decision-maker is present

  • access to gas, water and electricity

  • clear working areas

  • safe internal and external access routes

7.3. You are responsible for:

  • parking arrangements and permits

  • informing us of restrictions (distance, stairs, etc.)

  • obtaining permissions (landlord, freeholder, building control where required)

7.4. Failure to provide access may result in additional charges or cancellation.

8. Loft, Flue and External Access

8.1. Loft installations must have safe access, adequate lighting and suitable working space.

8.2. If loft conditions are unsafe or unsuitable, additional work may be required at your cost.

8.3. If flue routes are longer or more complex than expected, additional parts and labour may be required.

8.4. If safe external access cannot be achieved using standard ladders, scaffolding or specialist access equipment may be required at additional cost.

9. Existing System Condition (CRITICAL)

9.1. We do not carry out a full system inspection unless required by law.

9.2. We are not responsible for faults in existing systems or components not installed by us.

9.3. This includes (but is not limited to):

  • pipework and associated fittings;

  • radiators, radiator valves and TRVs;

  • valves, including motorised valves;

  • cylinders, tanks and associated controls (including wired and wireless/RF controls);

  • showers and associated fittings or controls;

  • pumps and associated fittings or controls;

  • existing electrical systems, wiring, controls, wiring centres and any RF or WiFi-related control issues;

  • hidden, enclosed or inaccessible services;

  • existing water or gas leaks;

  • any components showing signs of age, wear and tear, corrosion, discolouration or deterioration.

      “These items are outside the scope of the installation unless specifically agreed in writing.”

9.4. Installation may place additional stress on existing systems (including increased pressure or flow changes).

9.5. This may expose existing weaknesses, corrosion, blockages or prior poor workmanship.

9.6. We are not liable for:

  • leaks

  • failures

  • breakdowns

  • or damage caused by these pre-existing conditions

unless directly caused by our negligence.

10. System Flushing and Existing System Risks

10.1. Where a flush or cleaning process is carried out, results depend on the condition of the existing system.

10.2. In older or poorly maintained systems, disturbance of debris may expose faults or cause leaks.

10.3. We are not responsible for failures in existing systems following such work unless caused by our negligence.

11. Installation Process

11.1. We will carry out installation using reasonable care and skill.

11.2. Installation dates and times are estimates only.

11.3. Delays may occur due to factors outside our control.

11.4. We are not liable for:

  • loss of earnings

  • inconvenience

  • delays

  • or missed appointments

arising from such circumstances.

11.5. Additional visits may be required to complete works.

12. Behaviour and Safe Working Conditions

12.1. You must provide a safe and respectful working environment.

12.2. Threatening, abusive or unsafe behaviour will not be tolerated.

12.3. If such behaviour occurs:

  • work may stop immediately

  • engineers may leave

  • the contract may be cancelled

12.4. Costs incurred may still be payable.

13. Additional Works and Charges

13.1. Additional charges may apply where work exceeds the original scope.

13.2. This includes:

  • flue changes

  • gas upgrades

  • electrical work

  • access equipment

  • compliance upgrades

  • reattendance visits

13.3. We will explain costs before proceeding where possible.

14. Delivery and Materials

14.1. Materials may be delivered in advance.

14.2. You are responsible for their safety once delivered.

14.3. We are not liable for damage or loss outside our control.

15. Payment

15.1. Payment must be made as agreed.

15.2. We do not store card details.

15.3. Installation may be delayed if payment is not received.

15.4. Costs arising from chargebacks or payment disputes may be recovered.

16. Cancellation

16.1. You have a legal right to cancel within 14 days.

16.2. If work has started or materials ordered, reasonable costs may be deducted.

16.3. If installation has occurred, you must allow removal of equipment if applicable.

17. Our Right to Cancel

17.1. We may cancel where:

  • information is incorrect

  • access is not possible

  • installation is unsafe

  • required permissions are missing

  • abusive behaviour occurs

17.2. Refunds will be subject to reasonable deductions.

18. Warranty and Workmanship

18.1. Boilers are covered by manufacturer warranties.

18.2. We provide a 12-month workmanship guarantee covering installation carried out by us.

18.3. This covers defects directly resulting from our installation.

18.4. It does NOT cover:

  • existing system components

  • issues caused by old or defective systems

  • damage caused by pressure changes

  • interference by third parties after installation

  • misuse, neglect or lack of servicing

18.5. Annual servicing is required to maintain manufacturer warranties.

18.6. Where no fault is found or issues are outside our responsibility, a charge may apply.

19. Liability

19.1. We are responsible only for foreseeable loss caused by our negligence.

19.2. We are not liable for:

  • loss of income or business

  • delays outside our control

  • existing system failures

  • cosmetic impact of installation

19.3. Our total liability shall not exceed the amount paid.

20. Complaints

20.1. You must allow us reasonable opportunity to resolve any issue.

20.2. We will not cover third-party repair costs without prior approval.

21. General

21.1. These terms are governed by the laws of England and Wales.

21.2. If any part is invalid, the rest remains enforceable.

21.3. These terms form the full agreement between you and us.
